Questions to Ask Your Personal Injury Lawyer

If you are looking around for a personal injury lawyer, there are a handful of questions you should ask each candidate. The process is likely unfamiliar, and not doing your homework could lead to a very bad experience.

Do you have an escalating fee? At Glasheen, Valles & Inderman, we have a non-escalating, contingency, percentage fee, which means (1) you do not pay us anything unless we successfully resolve your case by settling or winning at trial, and (2) the percentage fee we collect never changes, so it does not matter if we settle your case the day after we are hired or if we have to go to trial and fight an appeal after that. Some law firms promise you a low 33% fee, but make sure that the fee does not escalate. Those low fees may only apply if the case is settled before a law suit is filed, but if a law suit is filed, the fee jumps from 33% up to 45% or even 50%. Read the contract very carefully and ask questions.
How are costs handled? At Glasheen, Valles & Inderman, we advance all litigation costs, and we never charge our clients interest. These costs could include law suit filing fees, court reporter fees for depositions and transcripts, expert witness costs, and travel costs. If we are ultimately not successful, the client is never asked to pay for those costs; we cover everything. Additionally, in Texas, we regularly advance reasonable and necessary living expenses to our clients while the case is pending so that they are not pressured to accept the first settlement offer. Some law firms may require you to pay interest on the costs. For example, if costs are $100,000 and the case took two years, at 5% interest, you’ll owe them not just the $100,000 in costs, but an additional $10,000 in interest. Also ask if you are expected to pay for the costs as they arise or if you only pay them at the end of the case.

How many cases have you personally tried? At Glasheen, Valles & Inderman, we have tried hundreds of cases. We have an in-house, litigation department dedicated to taking cases that require it from filing a lawsuit, through trial, and even through an appeal if necessary. We prepare every case as if it’s going to trial. This helps those cases settle. If you prepare to settle, you’ll end up going to trial. Not every case needs a lawsuit filed, but if your case does, you can rest assured that if you hire our firm to represent you, we will be the firm handling the case from start to finish. Other firms may specialize in negotiating with insurance companies, but may have limited experience actually trying cases in court in front of juries. If you happen to hire one of those firms, you will find that once your case requires a lawsuit, those law firms will often refer you to a different attorney because they do not have trial experience.
