What to Do After You've Been in a Drunk Driver Accident

If you’ve been involved in a drunk driving accident in Albuquerque, taking the right steps immediately after the incident can protect your health and legal rights. Here’s what you should do:

    1. Ensure Safety and Seek Medical Attention

First and foremost, your health is the top priority. Consequently, check yourself and others for injuries. Even if injuries seem minor, get medical treatment immediately. Subsequently, document all medical visits and treatments.

    2. Report the Accident

Next, call the Albuquerque Police Department to report the accident. Furthermore, ensure an official report is filed, as this will be crucial for your claim.

    3. Document Evidence

Additionally, if it’s safe to do so, take photographs of the accident scene, vehicle damage, and any visible injuries. Moreover, collect contact information from witnesses and other involved parties.

    4. Be Cautious with Insurance Companies

In most car accident cases, the other driver’s insurance company will handle the claim on their insured driver’s behalf. However, insurance companies spend millions on TV ads telling you they are “on your side,” are a “good neighbor,” or that you’ll “be in good hands” with them. Nevertheless, when negotiating with car insurance companies after an accident, none of this is true. Remember, insurance companies prioritize their profits. As a result, they may try to:

    • Deny your claim outright
    • Offer a quick, low settlement
    • Manipulate your statements
    • Question the severity of your injuries

Therefore, avoid giving detailed statements or accepting early settlement offers without legal advice.

    5. Contact Trusted Albuquerque Drunk Driving Accident Attorneys

After taking care of immediate health and safety concerns, it’s crucial to consult with experienced attorneys. Trusted Albuquerque Drunk Driving Accident Attorneys can:

    • Conduct a thorough investigation of your accident
    • Collect and analyze evidence, including police reports and medical records
    • Handle all communications with insurance companies
    • Ensure you receive proper medical treatment
    • Fight for fair compensation for your injuries, lost wages, and other damages

These attorneys understand Albuquerque’s traffic laws and insurance practices. Thus, they’re available to discuss your case and provide the guidance you need during this difficult time.

    6. Keep Records

Furthermore, maintain a file with all accident-related documents, including:

    • Medical bills and records
    • Correspondence with insurance companies
    • Photos of injuries and property damage
    • Records of missed work and lost wages

Lastly, adhere to your doctor’s recommendations and attend all follow-up appointments. This is crucial for your health and strengthens your claim. In conclusion, remember that the steps you take immediately after an accident can significantly impact your physical recovery and the outcome of any potential legal claim. At Glasheen, Valles & Inderman Injury Lawyers, we’re here to guide you through every step of the process, ensuring your rights are protected and you receive the compensation you deserve.

How Claims Against Drunk Drivers Work in Albuquerque

Albuquerque Drunk Driving Accident Attorneys understand the complexities of these cases. Here’s how claims against drunk drivers typically work in Albuquerque:

    Establishing Negligence

Driving under the influence of alcohol is considered an extreme form of negligence in Albuquerque. Victims injured or families who lose loved ones due to a drunk driver can hold that driver accountable for their injuries, similar to cases involving other reckless driving behaviors like tailgating or speeding.

    Criminal Charges and Civil Claims

In drunk driving accidents, the at-fault driver often faces serious criminal charges for DUI, not just a traffic citation. The progress of this criminal case can impact the civil claim for compensation by those injured or killed in the accident.

    Strategic Timing of Claims

Albuquerque Drunk Driving Accident Attorneys work with clients to make strategic decisions about when to file claims. While drunk driving accident injury lawsuits can proceed simultaneously with criminal prosecutions, in some cases, it may be advantageous to wait for the criminal case to conclude.

    Leveraging Criminal Convictions

If the driver pleads guilty or is convicted of DUI in criminal court, this can significantly strengthen the civil case. The criminal liability can help establish the civil liability necessary to recover damages in Albuquerque.

    Expertise of Local Attorneys

Albuquerque Drunk Driving Accident Attorneys possess in-depth knowledge of local laws and procedures. They can navigate the interplay between criminal and civil proceedings, ensuring the best possible outcome for their clients.

Our Team Is Here To Help

Below is a list of some of the most-frequently-asked questions by our clients and prospective clients. If you still have any questions, feel free to contact us.

    • Why should I hire an attorney?

Potential defendants are usually covered by insurance. The insurance companies are notified immediately when an accident occurs, and they usually hire attorneys and expert witnesses to investigate the claim. It is important that witnesses be interviewed as soon as possible and evidence be preserved. Witnesses will often be more difficult to locate or will have a poor memory if they are interviewed much later after the accident has occurred. Evidence such as machinery parts or skid marks on the highway will disappear unless preserved quickly. Insurance companies have insurance adjusters who will contact you and try to be friendly. You should not trust the statements that insurance adjusters make to you. They are not working for you and will sometimes make misleading statements in an effort to trick you into resolving your case. Insurance adjusters also might record your conversations with them and use your statements against you in order to try to save money for the insurance companies.

The main thing we try to impress upon people is that it’s never too early to talk to an attorney, and it’s always too late. By that we mean that speaking with an attorney very soon after a crash or other accident in no way will harm you. Along the same lines, the longer you try to handle a claim on your own or delay hiring competent counsel, irreparable damage can be done in the form of recorded statements given to the insurance companies and evidence not being preserved. There is no risk or fee for speaking with an attorney and arranging an initial consultation.

    • What if I am involved in a collision with a drunk driver?

Assuming that the drunk driver is covered by liability insurance, you have a very good claim against the drunk driver and his insurance company because under the law in Texas an accident victim is able to recover punitive damages from the drunk driver and his insurance company. It is for this reason that accidents with drunk drivers are can be very valuable claims.

    • If I am hit by a drunk driver, can I sue the bar where they got drunk?

Yes, but it is very important that you hire an experienced and aggressive dram shop attorney right away. The Dram Shop Act is very specific. It applies to bars, restaurants, night clubs and any other business that serves alcohol. Generally, there is no “social host” liability in Texas for serving adults, only commercial vendors of alcohol can be liable. (A “social host” can be liable for serving alcohol to minors.) If a business decides to keep serving beer or alcohol to an obviously intoxicated person and that person causes a motor vehicle accident, the business can be found liable for injuries caused by the intoxicated person.

    • What if the other driver left the accident scene without stopping?

Try to write down the license plate of the other vehicle. With that information we can attempt to track down the vehicle’s owner and obtain the insurance information on that vehicle. If we can get the insurance information, then the claim will proceed like any other type of motor vehicle accident claim. However, if it is not possible to track down the other driver’s information then we have to look at the client’s insurance coverage to see if they are covered by uninsured motorist coverage. If the client does not have uninsured motorist coverage it can be somewhat difficult to obtain any recovery for the client.
