The Experience and Drive You Need After a Truck Accident

Truck accident cases are rarely simple. They often involve multiple companies, complex federal rules, and serious injuries that can change lives in an instant. That’s why having experienced El Paso truck accident attorneys on your side makes all the difference.

What Makes Truck Accident Cases Different

    • Federal Safety Rules: Truck drivers and trucking companies must follow strict safety regulations set by the Federal Motor Carrier Safety Administration (FMCSA). When these rules are ignored, like exceeding hours of service or skipping maintenance, those violations can be powerful evidence of negligence.

    • Company Responsibility: In Texas, employers can be held accountable for the actions of their drivers when those actions happen on the job. If a driver’s carelessness causes a crash, the trucking company may share legal responsibility for your injuries.

    • Multiple Liable Parties: Many truck crashes involve more than just the driver. Maintenance contractors, cargo loaders, and even parts manufacturers can play a role. That’s why each case demands a careful investigation to uncover every source of fault. In El Paso, common causes include driver fatigue, overloaded trailers, and poorly maintained rigs.

    Exceptional Experience

The semi-truck injury attorneys at Glasheen, Valles & Inderman work closely with industry experts to inspect trucks involved in serious crashes. These inspections often uncover key safety violations, like poorly adjusted brakes or missed maintenance. With GPS systems common in most trucks, we can track a vehicle’s route and compare it to the driver’s logbook to spot inconsistencies. We also analyze data from the truck’s airbag control module (ACM), which can reveal speed, braking activity, steering input, and whether cruise control was engaged before the collision. In addition, our cell phone experts review call, text, and data records to determine if the driver was distracted at the time of the wreck.

    Causes of 18-Wheeler Accidents

Big-rig and 18-wheeler crashes often happen for the same reasons as car accidents, but the damage is usually far worse. Many of these wrecks can be traced back to violations of federal trucking laws or a failure to follow basic safety rules.

Common causes of truck driver negligence include:
    • Overloaded or improperly secured cargo

    • Following too closely (tailgating)

    • Driving past allowed hours and falling asleep at the wheel

    • Texting or distracted driving

    • Speeding or reckless driving

    • Driving under the influence of drugs or alcohol

    • Falsifying logbooks

    • Poor training or lack of a valid commercial license

    • Aggressive or road-rage driving

    Mechanical and Vehicle Problems

Not every truck accident is caused by human error. The Federal Motor Carrier Safety Administration (FMCSA) reports that around 10% of large-truck crashes come from equipment or mechanical failures. Many of these issues could have been prevented with proper inspection and maintenance.

Some of the most common mechanical failures in semi-truck crashes include:

    • Tire or wheel blowouts

    • Brake failure

    • Steering system failure

    • Engine or transmission problems

    • Suspension or axle issues

    • Shifting or unstable cargo

    • Trailer or hitch malfunctions

When these problems go unchecked, they can lead to devastating wrecks, like jackknifes, rollovers, rear-end collisions, and underride crashes. If you’ve been hurt in one of these situations, an experienced El Paso truck accident attorney can help uncover what went wrong and hold every responsible party accountable.

Federal Regulations and Truck Accident Injuries: Understanding Your Rights

    Federal Regulations

Commercial trucking is heavily regulated at the federal level to protect everyone on the road. The Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) require strict pre-employment screenings, drug testing, and routine vehicle inspections before and after every shift. These rules are meant to keep unsafe drivers and vehicles off the highways.

Federal law also limits the number of hours truck drivers can stay behind the wheel to reduce fatigue-related crashes. Drivers must keep accurate logbooks, display required placards, and maintain detailed records. Importantly, federal law bans texting or reading messages while driving—a rule that, sadly, some companies and drivers still ignore, putting lives at risk.

    Logbook Falsification

In many of our El Paso truck accident cases, we uncover evidence that drivers have falsified their logbooks to drive beyond the legal limit. Some trucking companies even pressure or reward drivers for making faster deliveries, encouraging them to break federal safety rules. When this happens, and someone gets hurt, those companies can and should be held accountable. Victims may be entitled to compensation for medical bills, lost wages, pain and suffering, and long-term care costs.

    Common Truck Accident Injuries

Because of their massive size and weight, 18-wheelers can cause catastrophic injuries when they collide with smaller vehicles. These injuries often include traumatic brain injuries, spinal cord damage, burns, fractures, amputations, and internal organ injuries. Sadly, many of these crashes result in fatalities.

Recovering from such devastating injuries can take years and the financial and emotional toll can be overwhelming. At Glasheen, Valles & Inderman Injury Lawyers, our El Paso truck accident attorneys are dedicated to helping victims and their families rebuild their lives. We fight to secure full compensation for medical care, rehabilitation, and future needs, while providing the compassion and support our clients deserve throughout the entire process.

Below, we present a list of the most frequently asked questions from our clients and prospective clients. If you have any additional questions, please don't hesitate to reach out to us.

    • I’ve been injured in a truck wreck, what should I know?

Truck wreck crashes can cause substantial injuries or death. It is critically important to contact an attorney immediately after a crash because of the nature of the evidence in these types of crashes. Our top priorities when investigating a new truck crash are to photograph the scene—including aerial drone photos of the scene—gather physical evidence, hire an expert engineer to download the engine control module data (like a black box), and talk to any witnesses. All of these things must be done in the hours or days after the crash.

Truck drivers are required to have a minimum of $750,000 of insurance if they drive intrastate and $1,000,000 if they drive interstate. Many trucking companies have more insurance than the required minimum. Our experience in truck driving cases helps us identify important evidence. We have found truck drivers falsifying their log books and driving in excess of the maximum amount of work hours allowed by DOT regulation.

    • Why should I hire an attorney?

Potential defendants are usually covered by insurance. The insurance companies are notified immediately when an accident occurs, and they usually hire attorneys and expert witnesses to investigate the claim. It is important that witnesses be interviewed as soon as possible and evidence be preserved. Witnesses will often be more difficult to locate or will have a poor memory if they are interviewed much later after the accident has occurred. Evidence such as machinery parts or skid marks on the highway will disappear unless preserved quickly. Insurance companies have insurance adjusters who will contact you and try to be friendly. You should not trust the statements that insurance adjusters make to you. They are not working for you and will sometimes make misleading statements in an effort to trick you into resolving your case. Insurance adjusters also might record your conversations with them and use your statements against you in order to try to save money for the insurance companies.

The main thing we try to impress upon people is that it’s never too early to talk to an attorney, and it’s always too late. By that we mean that speaking with an attorney very soon after a crash or other accident in no way will harm you. Along the same lines, the longer you try to handle a claim on your own or delay hiring competent counsel, irreparable damage can be done in the form of recorded statements given to the insurance companies and evidence not being preserved. There is no risk or fee for speaking with an attorney and arranging an initial consultation.

    • How and when do I pay for a personal injury attorney?

Most personal injury attorneys work on what is called a contingency fee basis, which means that you pay the attorney only if and when the attorney has successfully made a recovery in your case, either by settlement or by winning a jury trial. Our philosophy is that clients have enough to worry about, so clients at Glasheen, Valles & Inderman never pay us a dime out of their pockets directly; when you’re case is finished, the insurance company sends a check to our law firm, we take our percentage fee from that check, and send the remainder to the client.

In the rare event we are unable to make a recovery on your case, you still don’t pay us a dime, and that even includes case costs, court costs, expert fees, and any advances. There is truly zero risk in hiring a personal injury law firm like Glasheen, Valles & Inderman.
