Ask the Lawyer | What are the stages of a personal injury case?

Question:

What are the stages of a personal injury case?

Answer:

Typically on personal injury cases, we’re talking about automobile accidents or car crashes. In most of those cases, we work it up in what we call “prelitigation.”

We work up the case and try to settle the case with the insurance company without having to file a lawsuit. The reason we do that is that most of the time the crash report will tell us that the other person is at fault in causing the accident.

A lot of times we have to wait for our clients to finish their medical treatment. But then once we work up the case with the insurance company, if they’re not being reasonable with us as far as making a fair settlement offer to our client, then that’s when it goes into the lawsuit phase, and that’s when our litigation department takes over.
