EL PASO, Texas—A wrongful death lawsuit filed against Union Pacific Railroad after fatal derailment in El Paso, Texas.

Glasheen, Valles & Inderman Injury Lawyers, of El Paso, and Potroff & Karlin, of Manhattan, Kansas, announced the filing of a lawsuit Tuesday morning on behalf of the family of forty-nine-year-old Mario Navarro, who was killed when a Union Pacific Railroad train derailed. Mario left behind his wife of over 16 years, Monique, and their 13-year-old son and 11-year-old daughter.
During the day of August 29, 2022, Union Pacific Railroad maintenance placed a portable derail device on the lead track at the Alfalfa Yard to protect employees working on the track. When maintenance personnel completed their work they mistakenly left the portable derail device on the track and reported to other Union Pacific departments that the track was clear.
Later that evening, Mario was working as a conductor for Union Pacific Railroad at the Alfalfa Railyard along with other Union Pacific employees. It was dark and the area where Union Pacific directed him to work had poor lighting—an issue that had been raised multiple times to Union Pacific by other employees.
During the procedure Mario was riding on the lead end of the railcars in compliance with Union Pacific rules. The lead railcar struck the portable derail, derailing the two lead cars onto their side and crushing Mario.
“This family deserves answers,” said attorney Kevin Glasheen, one of the attorneys for the Navarro family. “This lawsuit will allow us the tools to conduct a thorough investigation to not only determine why this happened but to ensure it never happens again.”
