    Factors Leading to Motorcycle Collisions

Similar to serious car accidents, motorcycle wrecks often result from causes like drunk driving, distracted driving, and speeding. However, the smaller size and enhanced maneuverability of motorcycles introduce unique hazards, particularly when other drivers fail to acknowledge their presence nearby. Common types of motorcycle collisions include:

    Unsafe Lane-Changing Accidents

Due to their smaller stature and ability to move through traffic in ways cars can’t, motorcycles are extremely vulnerable to being hit by drivers changing lanes without thoroughly checking their blind spots.

    Rear-End Collisions

Motorcycles can come to a sudden stop much faster than larger vehicles. When a motorcycle halts unexpectedly, a following driver may collide with the rear, often resulting in severe head, back, or neck injuries

    Left-Hand Turn Accidents

In 2014, the National Highway Transportation Safety Administration reported that 40% of fatal two-vehicle motorcycle crashes involved other vehicles making left turns while motorcycles were proceeding straight or overtaking. Such accidents may stem from drivers’ failure to yield or misjudgment of motorcycle speed.

    T-Bone or Intersection Collisions

Factors leading to left-hand turn accidents, combined with other elements like disregarding red lights or stop signs and insufficient visibility of motorcycles obstructed by vehicles, contribute to intersection collisions.

    Single-Bike Accidents

Not all motorcycle crashes involve other vehicles. Hazardous road conditions such as uneven pavement, debris, potholes, mechanical issues, or other variables can cause bikers to lose control, resulting in laying down their bikes or colliding with stationary objects at high speeds.

    Injuries Resulting From Motorcycle Crashes

Motorcycle accidents can result in a range of injuries, some of which may have long-term effects. Common injuries include:

    Head Injuries

Even with a helmet, head injuries can occur. These can range from concussions to more severe traumatic brain injuries (TBI), which are injuries that affect brain function. According to the Insurance Institute for Highway Safety (IIHS), 61% of all individuals killed in motorcycle accidents in 2022 were wearing helmets. The NHTSA reports that 66.5% of motorcyclists used DOT-compliant helmets in 2022. Furthermore, helmets are 37% effective in preventing fatal injuries to motorcycle riders and 41% effective for passengers. They also reduce the risk of head injury by 69%.

    Spinal Injuries

Injuries to the spine can lead to partial or complete paralysis and require extensive medical treatment and rehabilitation.

    Broken Bones

Fractures, particularly to the arms, legs, and ribs, are common in motorcycle accidents and can require surgery and long recovery times.

    Road Rash

This is a painful skin injury that can lead to infections and significant scarring.

    Impactful Injuries

Unlike drivers of cars or trucks, motorcyclists lack the protective barriers and crush protection in the event of impact. Additionally, while helmets aren’t mandatory for motorcycle operators, their absence can be considered in legal proceedings if it worsens the victim’s injuries. Consequently, in motorcycle accidents, victims often endure severe injuries, including amputations, traumatic brain injuries, internal bleeding, fractures, comas, and tragically, wrongful death.

Motorcycle Safety Statistics: Understanding the Risks

Bikers face a significantly higher risk of injury and fatality compared to vehicle drivers. According to the National Safety Council, despite motorcycles comprising only 3% of all registered vehicles and accounting for 0.6% of all vehicle miles traveled in the United States, motorcyclists represented 14% of all traffic deaths, 18% of occupant fatalities, and 4% of occupant injuries in 2020.

The Insurance Institute for Highway Safety (IIHS) notes that in 2020, 5,579 American motorcyclists lost their lives, while approximately 82,500 suffered injuries in crashes. This marks the highest number of motorcycle crash deaths ever recorded, representing an 11% increase from 2019 and more than double the number of motorcyclist fatalities in 1997.

Our Team is Here to Help

    • What should I do after a motor vehicle accident?

Call 911 and report the accident.Move your vehicle off of the roadway, if it is possible to do so in a safe manner.
Do not apologize for the accident. If you are able, ask to see the other driver’s license and proof of insurance. From the driver’s license, write down the other driver’s name, address, date of birth and Texas driver’s license number. From the proof of insurance card, write down the name of the insurance company, the policy number and the insurance company’s telephone number if listed.

If anyone saw the accident and stopped afterwards, ask them what they saw, and make sure to write down their name and telephone number. Witnesses like this can be very helpful in determining who caused an accident.

Talk to a personal injury attorney before contacting the insurance.

    • What about motorcycle accidents?

Our firm has recovered millions of dollars for clients injured while driving motorcycles. Motorcycle cases present unique issues in the law and our experience can help you get the best recovery. Even though helmets are not required under Texas law, insurance companies will try to blame the motorcycle driver for not wearing a helmet. Other drivers often fail to yield to motorcycles and insurance companies try to blame the motorcycle driver for being difficult to see. Based on a review of the physical evidence, many times our expert witnesses can help establish that our client was operating legally at the time they were injured.

    • I’ve been hurt in an accident, and I keep getting phone calls and visits from people I don’t know.

An unfortunate and illegal practice in personal injury law is known as barratry, or more commonly referred to as ambulance chasing or case running. Lawyers and people who work for lawyers are prohibited from making unsolicited contact with potential clients in the form of in-person visits or telephone calls. Often times after a highly publicized accident where a potentially valuable claim exists, unethical lawyers will—either themselves or through someone they hire—attempt to contact the claimants or meet them at their homes or hospital rooms. Sometimes they pose as grief counselors, funeral home staff, or even healthcare providers like nurses.

Know that you have the right to refuse to talk to these people, and if possible, you should report them to the local authorities.
